Impact Bargaining, June 11, 2020

Bargaining teams from UFF-UNF and UNF-BOT met virtually on June 11, 2020 to discuss a prior proposal by UFF-UNF (4.30.2020, 6.3.2020) that requested UNF to formally agree to adopt and follow the Centers for Disease Control and Prevention (CDC) Guidelines during the exigency of the COVID-19 pandemic.  Adherence to the CDC guidelines was requested by UFF-UNF (4.3.2020) and also by the UNF COVID-19 Task Force (4.27.2020), the Florida Board of Governors (5.20.2020), UFF-UNF/UNF Faculty Association (6.2.2020), and the UFF/Florida Education Association (6.3.2020).  Together with an amended proposal, the UFF-UNF team presented additional information in support of their request, including the results of a UNF survey and testimonials by faculty. Through its Chief Negotiator (Mr. Mike Mattimore), the UNF-BOT offered language addressing UFF-UNF’s request.  The teams agreed to review one another’s proposals and meet again in the near future.  The UFF-UNF team’s proposal and presentation materials can be viewed here.  The UNF-BOT language can be viewed here.

Summary:
The UNF-UFF and UNF-BOT team met on November 1, 2019 for their 4th bargaining session for 2019-2020.  The meeting follows from the requirements of Article 38.2 of the UNF CBA that requires specific articles to be “reopened” and bargained in the third year of the 2017-2020 CBA. 

The UNF-UFF team opened the session providing documentation for their prior position that the faculty salary structure at UNF was at, or near, the bottom of SUS institutions and has been for more than a decade and in support of their salary proposal to begin to address the excessively low faculty salary structure at UNF.

  • The team showed prior minutes of the BOT meeting which documented that the current UNF Strategic Plan establishes an action item for the administration to raise faculty salaries “…to be above the median of peer and SUS institutions by discipline and rank…” was approved by the BOT in 2017, that the plan spans 2017-2024, and according to the BOT, “will be used as a working document for the new president.”
  • The team presented data from the College and University Professional Association and provided by the UNF-BOT team that documented that UNF faculty average salaries are 16% below the median of other SUS institutions. The team observed that these data are consistent with data provided by the National Education Association which shows that UNF faculty average salaries are 17% below other SUS institutions.
  • The team offered evidence that the peer institutions identified by the UNF-BOT team did not exist on UNF’s website. Moreover, the team offered evidence, based on communications with Institutional Research, that the data provided by the UNF-BOT team did not reflect any known list at UNF.
  • The team provided evidence that, based on review of SUS contracts, that UNF’s prior raise of 2% in combination with UNF-BOT’s proposed raise was, in fact, unremarkable. The team also cited a 2017 letter documenting that the UNF-BOT agreed with Coastal Florida PBA to an 8% raise for all employees under that union.
  • The team presented statistical evidence that, due to the lack of retroactivity to the beginning of the school year, that UNF-BOT’s salary proposal did not amount to 3% as claimed and the true amount was less for many faculty.
  • The team showed that due to increases in the cost of living over the last 3 years (i.e., increases in the level of prices relating to a range of everyday purchases), UNF-BOT’s salary proposal and prior year salary increase for UNF faculty were less than increases in the cost of living; leaving faculty economically worse off.

Drawing on the above, the UNF-UFF team again appealed to the UNF-BOT team to “acknowledge the facts,” and work together with the UNF-UFF team to address the excessively low faculty salary structure at UNF and to reach agreement on a new faculty salary structure that met the UNF-BOT’s stated goals and that would enable UNF to attain “national prominence” as envisioned by the new president.

The UNF-UFF team continued its presentation of information to inform salary discussions.  Having focused in the past on comparing UNF faculty salaries to faculty salaries at other SUS institutions, the UNF-UFF team presented data comparing the salaries of UNF administrators to UNF faculty.  The data revealed that over the last 10 years, the salaries of UNF administrator increased 25% while UNF faculty salaries rose only 15%.  The UNF-UFF team questioned the basis of the UNF administration providing itself with increases amounting to 25% across time, while providing faculty with only a 10% increase.  The UNF-UFF team further questioned the basis of the UNF administration provided itself salary increases while UNF faculty salaries were at or near the bottom of institutions in the SUS.

The UNF-UFF team then presented its salary proposal of a 9% across the board increase for faculty including full retroactivity to the beginning of the school year and inclusive of all faculty in the bargaining unit as of August 5, 2019.  The UNF-UFF team also presented called-for provisions addressing additional awards and salary increases.

Summary:
The teams discussed the proposed Task Force on Compression and Inversion with the BOT team proposing that in lieu of the task force that the matter be discussed at the bargaining table. The UFF team responded that it originally was the BOT team”s proposal for a task force, but that they would take the proposal under consideration.

The BOT team circulated salary data from various schools which they stated were peers. The UFF team responded with questions as to the choice of the schools and asked why the BOT team was not focusing on Florida SUS schools as the current UNF Strategic Plan focuses upon and that were the focus of the last bargaining session. 

The BOT team offered an amended salary proposal. After questions regarding its amount and format, the UFF team responded that they would further review the proposal.

Both teams heard from a management expert who described the impacts of UNFs salary structure on faculty, department, and university performance, and the impacts of the salary structure on long-term recruitment and retention of faculty. Based on UNF’s low salary structure relative to other Florida SUS schools, it was the opinion of the expert that UNF’s salary structure poses adverse impacts for performance, recruitment and retention and will pose challenges for UNF in meeting its future goals.

Summary:
The Faculty bargaining team presented data on the history of salary depression at UNF, and discussed a need to work collaboratively with the BOT team to move faculty salaries to the median level compared to other institutions with the state university system (SUS). The Board of Trustees set a goal for the UNF administration to 1) raise faculty “above the median” among peer and SUS institutions and 2) to ensure regular cost of living adjustment increases. Chief Negotiator, Greg Gundlach, delivered the Faculty team’s presentation and it starts around the 11:00 mark.

Summary: The administration’s bargaining team presents its position on salary and funding priorities. The faculty team reiterates that salary increases are possible when they are made a priority–a fact outline by Shari Schuman the March 1. The administration proposes a bulk proposal, although still in draft form, that addresses all open articles. The BOT Package Proposal can be viewed HERE. Shared governance is not included. Family leave would only be parental leave, which can be taken once in a faculty member’s career, and only after their sick leave has been drained. Summary: The faculty bargaining team rebuts several of the assertions made by the administration in the earlier session. Faculty insists on reasons for why the administration is rejecting all but one of the proposals outlined previously. The administration does not provide their reasoning. Data is presented related to pay inequity for women and minority faculty members, and faculty reiterate their commitment to a joint study on this matter. Data related to compression and inversion of salaries is given as well. Faculty stress the educational importance of a healthy ratio of full-time and adjunct faculty for summer courses. Questions about the requirement for librarians to go up for promotion are posed. Faculty rebut the assertion that paid family leave should be for new parents only, that faculty can only choose one child in their career to dedicate this kind of time to, that men and pregnant women should be forced to take sick leave when they are not sick, as well as several other problems the administration’s proposal raises.

Summary: Shari Schuman answers questions on fund sources and responds to UFF-UNF concerns about funding priorities and the financial management of the university.

Summary: UFF-UNF presented its salary proposal, which can be read HERE. Other supporting documents can be found HERE. The presentation recalls the failure of the university to uphold its strategic plan by providing regular cost of living increases.  It also shows how UNF is doing less in this regard than other SUS institutions.  The UFF-UNF bargaining team presents data that raises concerns about salary and promotion inequities based on gender and race.  The team proposes a timeline for a joint UNF and UFF-UNF study on this matter.  As well, the UFF team seeks to end the peculiar and expensive practice of paying former administrators who return to faculty their administrator salaries for jobs they no longer perform.  Finally, two UFF Faculty members presented on continuing compression/inversion discrepancies the unfairness of which causes faculty to suffer financially and in terms of morale.  They make the case that this would be relatively inexpensive to fix, though it gets more expensive each year that the situation is not addressed.

Part 2 run time: 34:03. Summary: This is the one to watch if you are interested in context.  The faculty team pressed outside counsel, Leonard Carson, about the proposals he submitted on behalf of the administration. Mr. Carson stated repeatedly that these were all subject to change and he was not prepared to sign a single article he presented. As a result, the UFF-faculty team does not consider these formal proposals, but rather drafts. We were told that at the next session in January we would finally receive formal proposals. Further, the faculty team and Mr. Carson engaged in a question and answer session about some of the content and intent of the administration’s draft.
