Budget Reserves

The Florida Auditor General’s Report No. 2016-175 Financial  Audit  (March 2016) (page 43) reveals that UNF computes the total pension liability by assuming that UNF employees (including faculty) receive an annual increase in salary of 3.5% (including an inflation adjustment of 2.6% percent). The result is that the total amount put into “reserves” is based on an estimate for a raise, even when all faculty do not receive a raise. These allocations to pension liability lock up recurrent funds that are no longer available for other uses at UNF.

The following is excerpted from Article 14.14 Development/Use of Instructional Technology of the 2014-2017 Collective Bargaining Agreement between UNF and UFF:

14.14 (e) Property Rights and Releases.

(1) Working Papers Rights. Consistent with law and other applicable provisions of this Agreement and the legitimate interests of the University, faculty members shall have the right to control of their personal correspondence, notes, raw data, and other working papers related to teaching materials, including instructional technology materials.

(2) Independent Works. Consistent with law and other applicable provisions of this Agreement, a work made in the course of independent efforts is the property of the faculty member, who has the right to determine the disposition of such work and the revenue derived from such work. As used in this Section, the term “independent efforts” means that: a. the ideas came from the faculty member b. the work was not made with the use of appreciable University support, and c. the University is not held responsible for any opinions expressed in the work.

Article 25 of the Collective Bargaining Agreement clarifies the rights of faculty and the University to teaching materials and products of scholarship. Faculty control all materials for teaching.

What it means to be a public employee in a “right to work” state

Florida, like many other states, has a constitutional “right to work” provision. While these right-to-work laws grant collective bargaining through a union that represents all of its constituents (members of the union or not), they do not guarantee the continuation of particular positions or a living wage. Conversely, right to work laws prohibit public employees from striking. Hence, unions in right to work states have significantly curtailed leverage in bargaining. Our union’s strength–at the bargaining table and beyond–comes from our membership; each additional member strengthens our ability to bargain for better work conditions.
